Final court decision regarding German deposit system
The Higher Administration Court (Oberverwaltungsgericht) in Berlin opens up for
deposit system by approving the German Government’s methods of calculating the
beverage container return ratio. The Higher Administration Court’s decision is
final. The effect of the decision is that the German Government is allowed to
publish the beverage container return ratio for 1999, which were below 72%. The
one-way beverage container ordinance from 1991 will be effective six months
after the numbers are officially published. It is expected that these numbers
will be published during the spring of 2002, and implies that the ordinance will
be effective from the fall of 2002. The ordinance currently only cover cans and
one-way bottles for beer and mineral water. According the German Environmental
Ministry (BMU), the survey for 2000 and 2001 probably shows that the return
ration is below the required limit. This would imply that all one-way packaging
for carbonized refreshment drinks would be included in the ordinance. The
deposit for beverage containers less than 1.5 liters will be 0.25 EURO, larger
containers will have a deposit of 0.5 EURO.
