Anotace tendru:

JRC-Ispra shromáždilo asi 1 200 nepoužívaných radioaktivních zdrojů, z nichž většina již je zařazena jako radioaktivní odpad, a to od různých jaderných experimentálních činností z minulých let, a snaží se odstranit tyto zdroje/odpad jejich přesunem do licencovaného jaderného úložiště a/nebo skladiště.
Očekávají se nabídky od zhotovitelů na odstranění výše uvedených zdrojů/odpadu, a to včetně převzetí veškerých zodpovědností s nimi souvisejících, viz výše. Zdroje/odpad práce hlavně zahrnují:
1) neutronové zdroje a/nebo odpad;
2) zdroje a/nebo odpad s individuální činností přesahující 10 Ci;
3) zdroje a/nebo odpad s individuální činností pod 10 Ci.
Rozsah služeb, které je třeba poskytnout, by měl zahrnovat i následující činnosti:
1. kampaň pro charakterizaci zdrojů/odpadu;
2. zabalení zdrojů/odpadu před přepravou;
3. přeprava mimo stanoviště;
4. převod zodpovědnosti.
Zhotovitel musí prokázat veřejnému zadavateli, že metoda navrhovaná k provedení zakázky splňuje všechny použitelné předpisy italské legislativy a legislativy ostatních států, a to včetně bezpečnostních předpokladů.
Nabídka do tendru musí být zpracována do 20. 3. 2007. Nabídka do tendru může být zpracována v jakémkoliv jazyce členského státu EU.

II.1) Description

II.1.5) Short description of the contract or purchase(s):
The JRC-Ispra has accumulated approximately 1 200 unused radioactive sources, the majority of which are already classified as radioactive waste, from various nuclear experimental activities conducted in the past years, and it aims at removing these sources/wastes transferring them to a licensed nuclear store and/or repository.
Proposals are sought from contractors for the removal of the above-mentioned sources/wastes, including, as specified here below, the contractor assuming all liabilities related to them. The sources/wastes mainly consist of:
1) neutron sources and/or wastes;
2) sources and/or wastes with an individual activity higher than 10 Ci;
3) sources and/or wastes with an individual activity lower than 10 Ci.
The extent of the service to be provided should comprise the following activities:
1. characterization campaign of the sources/wastes;
2. packaging of the sources/wastes prior to transport;
3. transport off-site;
4. transfer of liabilities.
The contractor will need to demonstrate to the contracting authority that the proposed method to execute the contract meets all the applicable Italian legislation and any other national legislation, including safety obligations.

The scope of the contract is to transfer to a licensed nuclear store and/or repository approximately 50 sources and/or wastes, with individual activity higher than 10 Ci, presently stored in a dedicated area of the JRC-Ispra.

Duration: 18 months from the award of the contract.
Lot No 3
Title: Sources and/or radioactive wastes with individual activity lower than 10 Ci
1) Short description:
Sources and/or wastes with individual activity lower than 10 Ci (as for example nuclear spikes or alpha and/or beta and/or gamma spectroscopy laboratory samples).
2) Common procurement vocabulary (CPV):

3) Quantity or scope:
The scope of the contract for this lot is to transfer to a licensed nuclear store and/or repository more than 1 100 sources and/or radioactive wastes (generally raised from radiochemical laboratory activities) presently stored in a dedicated area of the JRC-Ispra.

Duration: 18 months from the award of the contract.

Section III: Legal, economic, financial and technical information

III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:

III.1.3) Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
Candidatures can be submitted by consortia of economic operators who will not be required to adopt a particular legal form prior to the contract being awarded, but will be required to do so after the award. Furthermore, a consortium must nominate 1 member to be responsible for the receipt and processing of payments for members of the consortium, for managing the service administration, the service coordination and the associated safety and health aspects.
III.1.4) Other particular conditions to which the performance of the contract is subject:

Candidates must provide copies of all relevant licenses, permits, certificates of registration appertaining to the service being proposed. Candidates may rely on third economic operators upon submission of proof as regards their professional capacity and acceptance to perform the relevant services.
III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers:
Information and formalities necessary for evaluating if requirements are met:
1. Candidates or tenderers shall be excluded from participation in a procurement procedure if:
a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
b) they have been convicted of an offence concerning their professional conduct by a judgment which has the force of res judicata;
c) they have been guilty of grave professional misconduct proven by any means which the contracting authority can justify;
d) they have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed;
e) they have been the subject of a judgement which has the force of `res judicata` for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Communities` financial interests;
f) they are not enrolled, in accordance with procedures in force in the country of residence, on 1 of the professional, trade or equivalent registers if this is provided for under legislation in force in the country in which the tenderer is established;
g) following another procurement procedure or grant award procedure financed by the Community budget, they have been declared to be in serious breach of contract for failure to comply with their contractual obligations;
h) are subject to a conflict of interest;
i) are guilty of misrepresentation in supplying the information required by the contracting authority as a condition of participation in the contract procedure or fail to supply this information.
Candidates must certify that they are not in 1 of the above-mentioned situations.
The Commission accepts as satisfactory evidence that the candidates:
— are not in 1 of the situations described in points III.2.1(a), (b) and (e) above, a recent extract from the judicial record or, failing that, a recent equivalent document issued by a judicial or administrative authority in the country of origin or provenance showing that those requirements are satisfied,
— are not in the situation described in point III.2.1(d) and (f) above, a recent certificate issued by the competent authority of the State concerned.
Where no such document or certificate is issued by the country concerned, it may be replaced by a sworn or, failing that, a solemn statement made by the candidate before a judicial or administrative authority, a notary or a qualified professional body in his country of origin or provenance.
With respect to point III.2.1(g), (h) and (i), candidates shall provide a declaration signed by the legal representative of the candidate.

Objective criteria for choosing the limited number of candidates: operators who will be invited to participate in the competitive dialogue will be selected according to their professional capacity which will be assessed according to the following information to be provided by the candidates along with their request to participate:
a list of principal services — similar to those described in the present contract notice — provided by the bidder within the last 3 years with the sums, dates and recipients, public or private, involved. More weight will be given to candidates with a value above EUR 100 000.
