Anotace tendru:

Popis zakázky:
Stavební dohled zahrne přezkoumání projektu, dozor nad stavebními pracemi na výstavbách čistíren odpadních vod a souvisejících kanalizačních pracech během výstavby a období pro ohlašování závad u všech 3 položek, bude pro něj vytvořena nová smlouva jako samostatná zakázka Žluté
knihy FIDIC a bude se skládat z hlavních položek jak následují:
— Burgas-Meden Rudnik:
i) přestavba a rozšíření existující čistírny městských odpadních vod;
ii) výměna částí stávajícího hlavního sběrného kolektoru.
— Targoviště:
i) výstavba nové čistírny městských odpadních vod;
ii) rozšíření stávajícího hlavního sběrného kolektoru;
iii) výstavba nového sekundárního kolektoru;
iv) rozšíření sifonu hlavního kolektoru pod řekou Vrana.
— Popovo:
i) výstavba nové čistírny městských odpadních vod;
ii) rozšíření stávajícího hlavního sběrného kolektoru;
iii) napojení 21 výpustí do hlavního kolektoru;
iv) čerpací stanice odpadních vod a 2 vodní přemostění.
v souladu se Smluvními podmínkami FIDIC pro stavbu na klíč, první vydání 1999 (Žlutá kniha), technický dohled zahrne úkoly inženýra a také povinnosti dohlížitele v souladu s bulharskými zákony vztahujícími se na shora uváděné projekty. Zakázka bude rozdělena do 3 položek, jak to je uvedeno níže v bodě 8.

5. Contracting authority: Ministry of Environment and Water in the Republic of Bulgaria (MoEW).

Contract specification

6. Nature of contract:
Service — fee-based.
7. Contract description:
The supervision activities will include design review, supervision of the construction works for wastewater treatment plants and related sewerage elements during the construction and defect notification period for all 3 lots, which will be contracted as FIDIC Yellow Book contracts, and which will consist of the main items as follows:
— Bourgas-Meden Rudnik:
i) reconstruction and enlargement of an existing urban wastewater treatment plant;
ii) replacement of parts of the existing main collector.
— Targovishte:
i) construction of a new urban wastewater treatment plant;
ii) extension of the existing main collector;
iii) construction of a new secondary collector;
iv) extension of a siphon under the Vrana River of the main collector.
— Popovo:
i) construction of a new urban wastewater treatment plant;
ii) extension of the existing main collector system;
iii) connection of 21 outfalls to the main collector;
iv) a wastewater pumping station and 2 bridge river crossings.
Technical supervision shall include the duties of the engineer in accordance with FIDIC conditions of contract for plant and design-build, first edition, 1999 (Yellow Book) as well as the duties of a supervisor in accordance with Bulgarian legislation for the above-mentioned projects. The tender will be divided into 3 lots as indicated below in point 8.
8. Numbers and titles of lots:
Lot 1 — ISPA Measure No 2002 BG 16 P PE 009 — Bourgas-Meden Rudnik wastewater collection and treatment in Bulgaria.
Lot 2 — ISPA Measure No 2002 BG 16 P PE 010 — Targovishte wastewater collection and treatment in Bulgaria.
Lot 3 — ISPA Measure No 2002 BG 16 P PE 015 — Popovo wastewater collection and treatment in Bulgaria.
Each tenderer must submit 1 tender covering all 3 lots listed above.
9. Maximum budget:
Lot 1 — EUR 900 000;
lot 2 — EUR 975 000;
lot 3 — EUR 807 800.
Total for all 3 lots: EUR 2 682 800.

Conditions of participation

11. Eligibility:
Participation is open to all legal persons of the EU Member States and the countries and territories of the regions covered and/or authorised by the Regulations on access to Community external assistance and other specific instruments applicable to the programme under which the contract is financed (see also point 30 below). Participation of natural persons is directly governed by the specific instruments applicable to the programme under which the contract is financed.
12. Candidature:
All eligible natural and legal persons (as per point 11 above) or groupings of such persons (consortia) may apply.
A consortium may be a permanent, legally-established grouping or a grouping, which has been constituted informally for a specific tender procedure. All members of a consortium (i.e., the leader and all other members) are jointly and severally liable to the contracting authority.
The participation of an ineligible natural or legal person (as per point 11) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded.
13. Number of applications:
Each tenderer will have to submit 1 tender covering all 3 lots listed under point 8.
No more than 1 tender can be submitted by a natural or legal person (including legal persons within the same legal group), whatever the form of participation (as an individual legal entity or as leader or partner of a consortium submitting a tender). In the event that a natural or legal person (including legal persons within the same legal group) submits more than 1 tender, all tenders in which that person (and legal persons within the same legal group) has participated will be excluded.
Tenders for parts of the service will not be considered.
14. Shortlist alliances prohibited:
Not applicable.
15. Grounds for exclusion:
As a part of the tender, candidates must submit a signed declaration, included in the standard tender submission form to the effect that they are not in any of the exclusion situations listed in Section 2.3.3 of the Practical Guide to contract procedures for EC external actions (available from the following Internet address: http://europa.eu.int/comm/europeaid/index_en.htm).
16. Subcontracting:
Subcontracting will be allowed up to 30 % of the contract value. Subcontracting can be used for short-term experts and for supporting the activities envisaged for the key experts. Subcontracting can not be used for the execution of activities established for the key experts.

December 2006 or refer to the tender dossier, instructions to tenderers, item 2 `Timetable`.
20. Initial period of execution and possible extension of the contract:
The overall legal duration of this contract is expected to be 42 months, comprising 1 month period prior to the issue of the notice to commence the works, 24 months for construction, 12 months for the defects liability period and 5 months for final statement and payment. Extensions are possible depending on the progress of the works.

Selection and award criteria

21. Selection criteria:
The following selection criteria will be applied to candidates. In the case of applications submitted by a consortium, these selection criteria will be applied to the consortium as a whole:
1) Economic and financial capacity of candidate (based on item 3 of the service tender submission form):
(a) the annual turnover of the candidate for each of the last 2 years for which accounts have been closed shall amount at least EUR 1 000 000; and
(b) the firm or the leading partner of the consortium should have been operational for the last 2 years.
2) Professional capacity of candidate (based on items 4 and 5 of the service tender submission form):
(a) the candidate has at least 30 permanent professional staff with experience in supervising construction projects;
(b) the candidate has at least 15 permanent professional staff with experience in supervising FIDIC construction contracts.
3) Technical capacity of candidate (based on items 5 and 6 of the service tender submission form):
(a) the candidate shall have experience in the following fields of specialisation: supervision of wastewater treatment and sewerage works;
(b) the candidate shall have successfully completed at least 2 projects with an aggregate value of at least EUR 1 500 000 in the fields related to this contract (as described under point 21.3(a)) during the last 5 years (1.1.2001–the deadline for submission of tenders). For the purposes of this tender procedure, a project is considered `completed` if a taking over certificate has been issued for the works that have been supervised.
An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has with them. It must in that case prove to the contracting authority that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Under the same conditions, a consortium of economic operators may rely on the capacities of members of the consortium or of other entities.

Application

23. Deadline for receipt of applications:
27.10.2006 (17:00), local Bulgarian time or refer to the tender dossier, instructions to tenderers, item 2 `Timetable`.
Any application received after this deadline will not be considered.
24. Tender format and details to be provided:
Tenders must be submitted using the tender dossier and its annexes from the contracting authority (available at the Internet address www.moew.government.bg) whose format and instructions must be strictly observed. Should any tenderer have difficulties obtaining the tender dossier from the above-mentioned Internet address the tender dossier can also be requested ether by e-mail to margarita_h@moew.government.bg or by fax using the following number: (359-2) 981 43 93 or (359-2) 987 23 55.
The tender dossier is also available for inspection at the premises of the contracting authority. Tenders must be submitted using the service tender submission form included in the tender dossier, whose format and instructions must be strictly observed.
Tenderers with questions regarding this tender should send them in writing mentioning the publication reference and the title of the project, to:

at least 21 days before the deadline for submission of tenders given in point 23. The contracting authority must reply to all tenderers` questions at least 11 days before the deadline for submission of tenders. The above-mentioned is described in the tender dossier, instructions to tenderers, item 2 `Timetable`.
Any tender which does not observe these provisions will be automatically eliminated. Apart from the annual accounts required under point 21 any additional documentation (brochure, letter, etc.) sent with a tender will not be taken into consideration.
25. How tenders may be submitted:
Tenders must be submitted in English exclusively to the contracting authority:
— either by recorded delivery (official postal service) to:
Ministry of Environment and Water, Directorate `EU Funds for Environment`, 22 `Maria Louiza` Boulevard, 5th Floor,1000 Sofia, Bulgaria, Ms Margarita Hristova,
— or hand-delivered (including courier services) directly to the contracting authority in return for a signed and dated receipt to:
Ministry of Environment and Water, Directorate `EU Funds for Environment`, 22 `Maria Louiza` Boulevard, 5th Floor, 1000 Sofia, Bulgaria, Ms Margarita Hristova.
The contract title and the publication reference (see point 1 above) must be clearly marked on the envelopes containing the technical and financial offers and must always be mentioned in all subsequent correspondence with the contracting authority.
Applications submitted by any other means will not be considered.
26. Alteration or withdrawal of applications:
Candidates may alter or withdraw their applications by written notification prior to the deadline for submission of tenders. No application may be altered after this deadline.
Any such notification of alteration or withdrawal shall be prepared and submitted in accordance with point 25. The outer envelope (and the relevant inner envelope) must be marked `Alteration` or `Withdrawal` as appropriate.
27. Operational language:
All written communications for this tender procedure and contract must be in English.
28. Additional information:
The tenderers will have to submit tenders for each of the lots and the awarded tenderer will sign 3 contracts, 1 per each lot.
The contracting authority reserves the right to request references from the beneficiary/ries and/or candidates of the successfully-completed projects listed by the candidate in the submitted tender. The candidate should be ready to present such reference/s and/or further information related to the projects listed by the candidate upon request from the contracting authority during the examination of the submitted tenders.
Note: The tender procedure for this tender differs from the standard service tender procedure prescribed in the Practical Guide to contract procedures financed from the general budget of the European Communities in the context of external actions.
29. Date of publication of contract forecast:
25.6.2003 — initial publication of the contract forecast;
publication of the new contract forecast 17.1.2006.
The tender is re-launched after cancellation of the previous tender procedure.
30. Legal basis:
Council Regulation (EC) No 1267/1999 of 21.6.1999 establishing an instrument for structural policies for pre-accession, as amended by the Council Regulation (EC) No 2382/2001, the Council Regulation (EC) No 2500/2001, the Council Regulation No 769/2004, the Council Regulation (EC) No 2257/2004 and Council Regulation (EC) No 2112/2005.
