Contract description: Under the project should be executed: 1. construction of 15 sanitary sewerage systems on the territory of 13 communities of the Great Mazurian Lakes Region of 104 km total length and 72 basic sewage pumping stations; 2. construction and start-up of 2 new wastewater treatment plants in Warpuny-Zyndaki and Rybno in the Great Mazurian Lakes Region; 3. modernization of 2 wastewater treatment plants: extension of the existing WWTP from 90 cu.m/day to 500 cu.m/day in Pozezdrze and automation of WWTP in Stare Juchy in the Great Mazurian Lakes Region. 7. Number and titles of lots: Not applicable. Conditions of participation: 8. Eligibility and rule of origin: Participation is open on equal terms to all natural and legal persons [participating either individually or in a grouping (consortium) of tenderers] of the Member States of the European Union and the beneficiary countries of the Phare programme, Cyprus, Malta and Turkey. All goods provided for this contract must originate in these countries. 9. Grounds for exclusion: Tenderers must provide a declaration that they are not in any of the situations listed in Section 2.3 of the Manual of Instructions for External Relations contracts (available from the following Internet address: http://europa.eu.int/comm/europeaid/home_en.htm). 10. Number of tenders: Tenderers (including firms within the same legal group, other members of the same consortium and subcontractors) may submit only one tender. Tenders for parts of a lot will not be considered. No variant solutions will be considered. 11. Tender guarantee: Tenderers must provide a tender guarantee of 120 000 EUR when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties. 12. Performance guarantee: The successful tenderer will be requested to provide a performance guarantee of 10% of the contract value in euro when countersigning the contract. This must be delivered within 30 days after receipt by the tenderer of the contract signed by the contracting authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next lowest, compliant tender. 13. Information meeting and site visit: A clarification meeting and site visit will be held by the contracting authority on 12 July 2002. Tenderers wishing to attend shall advise the contracting authority thereof by fax no later then seven days before that date, giving the name and function of the person(s) that shall attend. Thereafter the contracting authority shall confirm in writing with the exact time and venue of the meeting. 14. Tender validity: Tenders must remain valid for a period of 90 days after the deadline for submission of tenders. 15. Maximum delivery period: 31 October 2003. Selection and award criteria: 16. Selection criteria: The pass/fail selection criteria for each tenderer include: 1. the tenderer shall be a registered firm [or natural person] capable of carrying out the specified works i.e. civil, mechanical and electrical works in branches: wastewater treatment plants and sanitary sewerage. 2. The average annual turnovers in the past 3 years shall be of at least 7 000 000 EUR. 3. The tenderer shall carry out at least 70% of the contract works by his own means. 4. The tenderer also must have access to credit and other financial facilities adequate to assure the required cashflow for the duration of the contract. In any case the credit amount available for the execution of the project (i.e. not already committed to other activities) should be a minimum of 2 000 000 EUR. 5. The tenderer shall have completed as main contractor at least 2 projects of a value not less than 5 000 000 EUR and the nature/complexity comparable to the tendered works over the last 3 years. This experience shall cover: total scope of works was no less than 100 km of sewers, waste water treatment plants of 500 cu.m/d total capacity. 6. All managers and key personnel shall have at least 15 years for the project manager and 10 years for other managers of adequate experience and proven qualifications relevant to the work of the nature similar to this contract. 7. Average profitability ratio from the last 3 years must be greater than 0. 17. Award criteria: Price. Tendering: 18.
