Contract specification 6. Nature of contract: Technical assistance. 7. Contract
description: Through this project, the consultant will provide assistance for
the preparation (terms of reference, technical specifications, etc.) of the
Phare 2001 projects components for environment, assist the Ministry of Waters
and Environmental Protection in its implementation and monitoring, and ensure
the necessary coordination. The main activities to be carried out are: 7.1.
support for tendering, contracting, monitoring and ensuring coordination for the
sub-project Implementation of the new Water Framework Directive on pilot basins;
7.2. support for tendering, contracting, monitoring and ensuring coordination
for the sub-project Environmental cost assessment and investment plan; 7.3.
support for tendering, contracting, monitoring and ensuring coordination for the
sub-project Assistance for the implementation of the IPPC Directive; 7.4.
institutional building focused mainly on improving the capacity to manage
environmental projects in accordance with the EU requirements (including
intensive training sessions), on identification of areas where projects
proposals should be elaborated and on preparing terms of reference for the
project preparation facility. 8. Numbers and titles of lots: Not applicable. 9.
Maximum budget: 500 000 EUR. 10. Scope for additional services: Not applicable.
Conditions of participation 11. Eligibility: Participation is open on equal
terms to all natural and legal persons of the Member States and the countries
and territories of the regions covered and/or authorized by the regulation or
other specific instruments applicable to the programme under which the contract
is financed (see also point 28 below). 12. Candidature: All eligible natural and
legal persons (as per item 11 above) or groupings of such persons (consortia)
may apply. A consortium may be a permanent, legally established grouping or a
grouping which has been constituted informally for a specific tender procedure.
All members of a consortium (i.e. the leader and all other partners) are jointly
and severally liable to the contracting authority. The participation of an
ineligible natural or legal person (as per item 11) will result in the automatic
exclusion of that person. In particular, if that ineligible person belongs to a
consortium, the whole consortium will be excluded. 13. Number of applications:
Candidates (including firms within the same legal group, other members of the
same consortium, and subcontractors) should submit only one application for the
current contract (lot), whatever the form of participation (as an individual
candidate, or as leader or partner of a consortium candidate). In the event that
a natural and legal person submits more than one application, all applications
in which that person has participated will be excluded. 14. Shortlist alliances
prohibited: Any tenders received from tenderers comprising firms other than
those mentioned in the shortlisted application forms will be excluded from this
restricted tender procedure. Shortlisted candidates may not form alliances or
subcontract to each other for the contract in question. 15. Grounds for
exclusion: As part of the application form, candidates must declare that they do
not fall into any of the categories listed in Section 2.3 of the Manual of
Instructions for External Relations contracts (available from the following
Internet address: ). 16. Subcontracting: Subcontracting is allowed. The value of
the subcontracted part of the services may not exceed 30% of the contract value.
17. Number of candidates to be shortlisted: On the basis of the applications
received, at least 4 and at most 8 candidates will be invited to submit detailed

February 2003. 20. Initial contract duration and possible extension: 30 months
with possibility for extension. Selection and award criteria 21. Selection
criteria: 1: Economic and financial standing of candidate (individual company or
JV/consortium) [based on item 3 of the application form]: (a) the average annual
turnover of the candidate (individual company or JV/consortium altogether) over
the last three years must exceed 1 000 000 EUR; (b) the average annual operating
profit of the candidate (individual company or the leader only, in case of
JV/consortium) over the last three years must be positive. 2: Professional
capacity of candidate (individual company or JV/consortium) [based on items 4
and 5 of the application form]: (a) the number of the permanent staff of the
candidate (individual company or JV/consortium altogether) working for the
fields related to this contract exceeds 20 people; (b) the candidate (individual
company or JV/consortium altogether) will need to demonstrate expertise in all
the fields of specialization related to this project. 3: Technical capacity of
candidate (individual company or JV/consortium) [based on items 5 and 6 of the
application form]: (a) the candidate (individual company or JV/consortium
altogether) has relevant international experience and implemented at least two
projects of similar nature and complexity as described under points 7.1 and 7.3
above in accordance with EU requirements, during the past five years; (b) the
candidate (individual company or JV/consortium altogether) has relevant
experience in implementing at least one project of similar nature and complexity
as described under point 7.2 above, during the past five years; (c) the
candidate (individual company or JV/consortium altogether) has relevant
experience in implementing at least two projects for institutional capacity
building for project management and procedures for decentralized implementation,
during the past five years. 22. Award criteria: As specified in the tender
dossier annexed to the letter of invitation to tender which will be sent to
shortlisted candidates. Application 23. Deadline for applications: 30 September
