The Ventspils non-profit municipal enterprise Udeka, will be the contracting
party and become the Employer (as per FIDIC) in the contract on behalf of the
contracting authority. Contract specification 6. Contract description: The
measure is part of the development of water services in Ventspils project,
Ventspils City, Latvia, (population 44 000) is a major port on the Baltic sea
coast and Latvias 6th largest City. The project is to be carried out under plant
and design-build for electrical and mechanical plant and for building and
engineering works, designed by the contractor FIDIC 1999 conditions of contract
(FIDIC Yellow Book conditions of contract). The works comprise: construction of
new groundwater artesian wells and collector pipeline; rehabilitation and
reconstruction of water supply rising mains; construction of water treatment
plant and iron removal plant; construction of wastewater treatment plant;
reconstruction of wastewater pumping stations; supply of laboratory equipment.
7. Indicative number and titles of lots: The works contract is divided into 2
lots. Tenders may be submitted for one or both lots: lot 1: reconstruction of
water supply collector system and rising mains, and construction of water
treatment/iron removal plant; lot 2: construction of wastewater treatment plant
and pumping stations and supply of laboratory equipment. Conditions of
participation 8. Eligibility and rule of origin: Participation is open on equal
terms to all natural and legal persons [participating either individually or in
a grouping (consortium) of tenderers] of the Member States and the countries and
territories of the regions covered and/or authorized by the regulation or other
specific instruments applicable to the programme under which the contract is
financed (see 21). All goods provided for this contract must originate in these
countries. 9. Grounds for exclusion: Tenderers must provide a declaration that
they are not in any of the situations listed in Section 2.3 of the Manual of
Instructions for External Relations contracts (available from the following
Internet address: europa.eu.int [http://europa.eu.int/comm/europeaid/]
index_en.htm). 10. Number of tenders: Tenderers (including firms within the same
legal group, other members of the same consortium, and subcontractors whose
subcontract amount is above 5% of the tender price) may submit tenders only one
tender for one or several lots. Tenders for parts of a lot will not be
considered. Any tenderer may state in their tender that they would offer a
discount in the event that its tender is accepted for more than one lot.
Tenderers may not provide a tender for a variant solution in addition to their
tender for the works required in the tender dossier. 11. Tender guarantee:
Tenderers must provide a tender guarantee of one hundred thousand euro (100 000
EUR) if tendered for lot 1 or lot 2 only, or two hundred thousand euro (200 000
EUR) if tendered for both lots, when submitting their tender. This guarantee
will be released to unsuccessful tenderers once the tender procedure has been
completed and to the successful tenderer(s) upon signature of the contract by
all parties. 12. Performance guarantee: The successful tenderer will be
requested to provide a performance guarantee of 10% of the contract value in
euro when countersigning the contract. This must be delivered within 30 days of
receipt by the tenderer of the contract signed by the contracting authority. If
the selected tenderer fails to provide such a guarantee within this period, the
contract will be void and a new contract may be drawn up and sent to the
tenderer which has submitted the next lowest, compliant tender. 13. Information
meeting and site visit: A mandatory information meeting and site visit will be
held on - information meeting 25th November 2002, 14.00, - site visit 25th
November 2002, 11.00. Both events will take place at the offices the Municipal
Water Enterprise (UDEKA), Talsu iela 65, Ventspils, Latvia. 14. Tender validity:
Tenders must remain valid for a period of 90 days after the deadline for
submission of tenders. 15. Maximum delivery period: 23 calendar months.
Selection and award criteria 16. Selection criteria: The main selection criteria
that will be evaluated to confirm compliance with the criteria stated in the
tender dossier: - the average annual turnover of the candidate in the past 3
years shall be at least 2,5 times the value of the works tendered; - access to
credit facilities: at least one million euro (1 000 000 EUR) if tendering for
lot 1 or lot 2 only; at least two million euro (2 000 000 EUR) if tendering for
both lots and adequate to assure the required cashflow for the duration of the
contract; - ability to carry out of the works by own means: main contractor at
least 70%, leading partner in a joint venture/consortium at least 50%, another
partner in a joint venture/consortium at least 10%; - successful experience as a
prime contractor in 2 completed projects of the same, nature/amount/complexity
comparable to the tendered works during the last 5 years; - experience of the
key staff: technical director, project manager and main engineer should have at
least 5 years of adequate experience and proven qualifications relevant to works
of a similar nature to this project; - successful experience as prime designer
in projects of the similar nature/amount/complexity comparable to those of the
tendered works over the last 5 years. Only those tenders which comply with the
administrative and technical criteria will be included in the evaluation of the
