Wastewater Treatment Plant Rehabilitation Project
This Invitation for Tenders follows the General Procurement Notice for this project, which was published on the EBRD Web site on March 26, 2004.
The S.C. Apa – Canal S.A. has been granted a loan from the European Bank for Reconstruction and Development (“the EBRD”) towards the cost of a project to finance investments in the Waste Water Treatment Plant Rehabilitation Project.
The S.C. Apa – Canal S.A. now invites sealed Tenders from contractors for the following contract to be funded from part of the proceeds of the loan:
The implementation of the Rehabilitation of the Wastewater Treatment Plant for about 260,000 population equivalent and an average daily flow of about 77,000 m³. Covering amongst others rehabilitation of civil constructions, a new sand and grease removal, new sludge thickening and dewatering building and equipment, new digested sludge storage tank and gas burner, new aeration and new cogeneration equipment, enlargement of sludge dewatering building with blower installation, rehabilitation of the sludge digester and gas storage tank, replacement of equipment and electrical installations and the installation of a PLC SCADA system. The treated effluent shall have to comply with the EC Urban Waste Water Treatment Directive 91/271/EEC for discharge into non-sensitive waters.
It is intended that the contract will be awarded in the second quarter of 2005 with a planned Time for Completion of the Works of 30 months after the Commencement date. The Works will be executed under FIDIC Conditions of Contract for Plant and Design-Build, First edition 1999.
Tendering for contracts to be financed with the proceeds of a loan from the EBRD is open to firms and joint ventures from any country.
The proceeds of the Bank’s loan will not be used for payments to persons or entities or for import of goods if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations.
The Tenderer shall furnish, as part of its Tender, documentary evidence of the Tenderer’s qualifications to perform the contract if its Tender is accepted, establishing to the employer’s satisfaction that:

(i) The tenderer should have an average annual turnover in similar jobs in the water and wastewater sector (defined as billing for work in progress and completed) over the last three (3) years of at least ten (10) million Euro or its equivalent.
(ii) In the case of a Joint Venture, the partner in charge shall meet the average annual turnover, specified above, with at least fifty (50 %) percent. Each of the partners shall meet not less than twenty five (25 %) percent of the qualifying criteria mentioned above.
(iii) The Tenderer should demonstrate that it has access to, or has available liquid assets, unencumbered real assets, lines of credit, and/or other financial means of not less than two (2) million Euro equivalent and sufficient to meet the contract cash flow requirements for the project.
(iv) The Tenderer should have successful experience as a main contractor in the “design and build” of at least three (3) projects with a value of not less than ten (10) million Euro or its equivalent. The projects shall be of a nature and complexity comparable to this contract, and shall have been executed within the last seven (7) years.
(v) The Tenderer has the necessary plant and equipment and experienced site staff to execute the project in the time scale and within the required costs.
Tender documents may be obtained from the office at the address below upon payment of a non-refundable fee of Euro 400 (Four Hundred Euro) or its equivalent in Romanian Lei. Payment may be made by cheque to S.C. Apa-Canal S.A. Sibiu, in cash directly to the cashier S.C. Apa-Canal S.A. Sibiu, or by inter-bank transfer to S.C. Apa-Canal S.A. Sibiu bank Account (BCR Sibiu RO82 RNCB 4200 0000 0035 0001) Cheque and bank transfer charges to be paid by the applicant. If requested, the documents will be promptly dispatched by airmail in exchange for payment, but no liability can be accepted for loss or late delivery. Only parties that purchase the Tender documents will be considered eligible to submit Tenders.
All Tenders must be valid for 120 days and be accompanied by a Tender security in amount of 2 % of the Tender price.
The Clarification meeting and Site visit will be organised by S.C. Apa-Canal S.A. Sibiu on 16 March 2005, 10:00 hrs local time at:

Tenders must be delivered to the office at the address below, on or before 12:00 hrs local time on 22th April 2005. Tenders will be opened on 22 April 2005, 12:00 hrs local time in the presence of those Tenderers’ representatives who choose to attend.
