Anotace tendru:

EIB (Evropská investiční banka) financuje technickou pomoc při realizaci druhého projektu snižování znečištění v Egyptě (EPAP II). Maximální rozpočet je 2.8 mil. EUR. Výzva k projevení zájmu má uzávěrku 18.1.2007, předpokládá se, že pozvání do tendru bude uskutečněno koncem ledna 2007.

7.Contract description
The objective of the Technical Assistance (TA) is to support the implementation of the second Egyptian Pollution Abatement Project (EPAP II). The specific objectives are to develop and improve: (i) the capacity of the Egyptian Environmental Affairs Agency (EEAA) to manage and co-ordinate EPAP II; (ii) the capacity for the efficient selection and preparation of sub-projects by the EEAA for funding under EPAP II; (iii) the capacity for efficient and transparent procurement of works and services by industrial companies for EPAP II sub-projects; (iv) the capacity for efficient financial management and disbursement of funds for EPAP II sub-project implementation in EEAA and participating banks; (v) the capacity for efficient implementation of EPAP II sub-projects in EEAA and final recipients. A further objective is to increase awareness on economic and environmental benefits resulting from the implementation of sub-projects under EPAP II.

10.Scope for additional services
The Contracting Authority may, at its own discretion, extend the project in duration and/or scope subject to the availability of funding, up to a maximum not exceeding the length and value of the initial contract. Any extension of the contract would be subject to satisfactory performance by the Contractor.

CONDITIONS OF PARTICIPATION

11.Eligibility
Participation is open on equal terms to all natural and legal persons of the EU Member States and the countries and territories of the regions covered and/or authorized by the Regulation or other specific instruments applicable to the programme under which the contract is financed (see also item 30 below) and the Regulation on access to Community external assistance. (Regulation (EC) No 2110/2005 of the European Parliament and of the Council of 14 December 2005 on access to Community external assistance and Council Regulation (EC) No 2112/2005 of 21 November 2005 on access to Community external assistance).
12.Candidature
All eligible natural and legal persons (as per item 11 above) or groupings of such persons (consortia) may apply.
A consortium may be a permanent, legally established grouping or a grouping which has been constituted informally for a specific tender procedure. All members of a consortium (i.e., the leader and all other partners) are jointly and severally liable to the Contracting Authority.
The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded.
13.Number of applications
No more than one application can be submitted by a natural or legal person (including legal persons within the same legal group), whatever the form of participation (as an individual legal entity or as leader or partner of a consortium submitting an application). In the event that a natural or legal person (including legal persons within the same legal group) submits more than one application, all applications in which that person (and legal persons within the same legal group) has participated will be excluded.
14.Shortlist alliances prohibited
Any tenders received from tenderers comprising firms other than those mentioned in the short-listed application forms will be excluded from this restricted tender procedure. Short-listed candidates may not form alliances or subcontract to each other for the contract in question.
15.Grounds for exclusion
As part of the application form, candidates must submit a statement to the effect that they are not in any of the exclusion situations listed in Section 2.3.3 of the Practical Guide to contract procedures financed from the General Budget of the European Communities in the context of external actions (available from following Internet address: http://europa.eu.int/comm/europeaid/index_en.htm).
16.Sub-contracting
Sub-contracting is not allowed without prior written consent of the Contracting Authority.
17.Number of candidates to be short-listed
On the basis of the applications received, at least 4 and at most 8 candidates will be invited to submit detailed tenders for this contract.

SELECTION AND AWARD CRITERIA

21.Selection criteria
The following section will be applied to candidates. In case of applications submitted by a consortium, these selection criteria will be applied to the consortium as a whole:
1) Economic and financial standing of candidate(s):
(i) For each of the last three years, total annual turnover of candidate(s)/applicants must exceed the budget of the contract.
2) Professional capacity of candidate(s):
(i) At least 10 % of all members of staff working for the candidates work in fields related to this contract.
(ii) At least 20% of all staff working for the candidate this year in fields related to the contract are permanent.
3) Technical capacity of candidate(s):
(i) The candidate should have a demonstrated track record in the fields of industrial pollution abatement, procurement, financing, marketing and training; the candidate has at least one major assignment of at least 5 years in the field of international project management and institutional development, preferably in developing countries, related to the fields above.
(ii) Proven experience in setting up and running such an operation in a transition country, preferably in the Mediterranean region.
(iii) Proven capacities to provide backstopping and to recruit and manage technical assistance teams.
An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has with them. It must in that case prove to the Contracting Authority that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Under the same conditions, a consortium of economic operators may rely on the capacities of members of the consortium or of other entities.
If more than 8 eligible candidates meet the above selection criteria, the relative strengths and weaknesses of the applications of these candidates must be re-examined to identify the eight best applications for the tender procedure. The only factors which will be taken into consideration during this re-examination are:
- the number and size of operations in the relevant areas described under point 21(3).
22.Award criteria
As specified in the tender dossier annexed to the letter of invitation to tender which will be sent to short-listed candidates.

Applications submitted by any other means will not be considered.
26.Alteration or withdrawal of applications
Candidates may alter or withdraw their applications by written notification prior to the deadline for submission of tenders. No application may be altered after this deadline.
Any such notification of alteration or withdrawal shall be prepared and submitted in accordance with Clause 25. The outer envelope (and the relevant inner envelope) must be marked `Alteration` or Withdrawal` as appropriate.
